These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “You,” or “Your”) and IndiCar (“IndiCar,” “We,” “Us,” or “Our”). These Terms govern your access to and use of our Platform, including all information, tools, services, and interactions facilitated by IndiCar in collaboration with third-party dealerships, insurers, lenders, and vendors.

Please read these Terms carefully. By accessing or using the Platform or any of the Services provided herein, you acknowledge and confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

1. Description of Platform and Services

IndiCar operates as an online technology-based platform that facilitates the sale and discovery of new and used cars, car loans, motor insurance, and related automobile services offered by third-party partners (“Service Providers”).

We act solely as a facilitator and intermediary between you and authorized dealers, financial institutions, or insurers. IndiCar does not manufacture, own, finance, insure, or provide warranties for any vehicles or third-party products.

Our Services include but are not limited to:

• Aggregating and displaying listings of new and used vehicles;
• Facilitating test drive bookings and dealership interactions;
• Price discovery and on-road price calculations;
• Enabling loan and insurance quotes via partner institutions;
• Assisting in car exchange and resale services;
• Promoting offers from participating dealerships.

We may modify, suspend, or discontinue any part of the Services at our sole discretion, without prior notice or liability.

2. Limitation of Role

We are not responsible for the actions, omissions, misrepresentations, or breaches of contract or law by any third-party dealer, lender, or insurer.

All transactions, including documentation, payments, delivery, refunds, and disputes, are executed directly between you and the third party.

You agree and acknowledge that IndiCar shall not be liable for:

• The quality, condition, or warranty of vehicles;
• Delays, delivery issues, cancellations or defects;
• Non-availability of any specific model, variant, or offer;
• Any rejections or conditions imposed by lenders or insurers.

3. User Responsibilities

You agree:

• That you are above 18 years of age and legally competent.
• To provide truthful, accurate, and complete information.
• To be responsible for any use of your account and any transactions under it;
• To not misuse the Platform for unlawful or unauthorized purposes.

4. Payment and Pricing

Prices displayed are indicative and may change without prior notice.

• All payments made towards booking, loan processing, or insurance are governed by the respective third party’s terms.
• IndiCar may receive a commission from third parties without affecting your payable amount.
• We do not accept responsibility for any failed transactions or unauthorized payments.

5. Cancellations and Refunds

Cancellations initiated by Users may be subject to fees as determined by the respective seller or service provider.

• IndiCar is not liable for refunds or delays once payment is made to a third party.
• Any refunds or claims must be pursued directly with the seller/insurer/lender involved.

6. Intellectual Property

All content, trademarks, software, logos, and designs on this Platform are the property of IndiCar or its licensors. You may not reproduce, republish, or distribute any content without our prior written consent.

7. No Warranties; Use at Your Own Risk

All services and information on this Platform are provided on an “as-is” and “as-available” basis. We disclaim any warranties, express or implied, including:

• Fitness for a particular purpose;
• Accuracy, completeness, or reliability of data;
• Non-infringement.

Use of our Platform and Services is entirely at your own risk.

8. Limitation of Liability

In no event shall IndiCar, its proprietor, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use or inability to use the Platform.

Our maximum aggregate liability under these Terms shall not exceed INR 1,000 or the amount paid by you for using the Services, whichever is lesser.

9. Indemnity

You agree to indemnify and hold harmless IndiCar and its proprietor against all losses, liabilities, claims, damages, legal fees, and costs arising out of:

• Your misuse of the Platform;
• Breach of any representation or obligation;
• Disputes with any third party arising from a transaction facilitated through IndiCar.

10. Force Majeure

IndiCar shall not be held responsible for any delay or failure to perform due to causes beyond our control including acts of God, natural disasters, war, terrorism, government restrictions, internet outages, or third-party failure.

11. Communication Consent (DND Waiver)

By using the Platform, you consent to receive calls, SMS, emails, or WhatsApp messages from IndiCar or its partners for transactional or promotional purposes, irrespective of your DND/NDNC registration.

12. Jurisdiction and Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.

13. Updates and Revisions

We reserve the right to modify these Terms at any time without notice. Continued use of the Platform implies acceptance of the modified Terms.
